\nVATICANO, 23 Oct. 14 \/ 12:08 pm (ACI\/EWTN Noticias).- El Papa Francisco dirigi\u00f3 este jueves un discurso a una delegaci\u00f3n de la Asociaci\u00f3n Internacional de Derecho Penal en la que conden\u00f3 las ejecuciones extrajudiciales y la pena de muerte -medida incluso usada por reg\u00edmenes totalitarios para suprimir a la disidencia y perseguir a las minor\u00eda<\/strong>s-, y afirm\u00f3 que el respeto a la dignidad humana debe ser el l\u00edmite a cualquier arbitrariedad y exceso por parte de los agentes del Estado.<\/span>

\nEn su discurso el Santo Padre reafirm\u00f3 la condena absoluta de la pena de muerte, que para un cristiano es inadmisible; as\u00ed como las llamadas \u00bbejecuciones extrajudiciales\u00bb, es decir los homicidios cometidos deliberadamente por algunos estados o sus agentes y presentados como consecuencia indeseada del uso razonable, necesario y proporcional de la fuerza para aplicar la ley.<\/span>

\nFrancisco se\u00f1al\u00f3 que los argumentos contra la pena de muerte son conocidos. La Iglesia \u2013indic\u00f3-, ha mencionado algunos, como la posibilidad del error judicial y el uso que le dan los reg\u00edmenes totalitarios como \u00bbinstrumento de supresi\u00f3n de la disidencia pol\u00edtica o de persecuci\u00f3n de las minor\u00edas religiosas o culturales\u00bb.<\/span>

\nTambi\u00e9n se refiri\u00f3 a las condiciones deplorables de los penitenciarios en buena parte del planeta. Dijo que aunque a veces se debe a la carencia de infraestructuras, otras son el resultado del \u00bbejercicio arbitrario y despiadado del poder sobre las personas privadas de libertad\u00bb.<\/span>

\nFrancisco no olvid\u00f3 la aplicaci\u00f3n de sanciones penales a los ni\u00f1os y ancianos condenando su uso en ambos casos. Adem\u00e1s conden\u00f3 la trata de personas y la esclavitud, \u00bbreconocida como crimen contra la humanidad y crimen de guerra tanto por el derecho internacional como en tantas legislaciones nacionales\u00bb.<\/span>

\nEl Papa tambi\u00e9n se refiri\u00f3 a la pobreza absoluta que sufren mil millones de personas y la corrupci\u00f3n. \u00bbLa escandalosa concentraci\u00f3n de la riqueza global es posible a causa de la connivencia de los responsables de la cosa p\u00fablica con los poderes fuertes. La corrupci\u00f3n, es en s\u00ed misma un proceso de muerte..<\/strong>. y un mal m\u00e1s grande que el pecado. Un mal que m\u00e1s que perdonar hay que curar\u00bb, advirti\u00f3.<\/span>

\n\u00bbLa cautela en la aplicaci\u00f3n de la pena debe ser el principio regidor de los sistemas penales… y el respeto de la dignidad humana no s\u00f3lo debe actuar como l\u00edmite de la arbitrariedad y los excesos de los agentes del Estado, sino como criterio de orientaci\u00f3n para perseguir y reprimir las conductas que representan los ataques m\u00e1s graves a la dignidad e integridad de la persona\u00bb, concluy\u00f3.<\/span>

Vatican, 23 Oct. 14 \/ 12:08 pm (ACI\/EWTN News).-Pope Francisco led Thursday a speech to a delegation of the International Association of criminal law in which condemned the extrajudicial executions and the penalty of death – measured even used by totalitarian regimes to suppress dissent and persecute the minorities- and stated that respect for human dignity should be the limit to any arbitrariness and excess by agents of the State.<\/span>

\nIn his address the Holy Father reaffirmed the absolute condemnation of the death penalty, which, for a Christian, is inadmissible; as well as so-called \u00abextrajudicial executions\u00bb, i.e. the killings committed deliberately by some States or their agents and presented as a result unwanted use of reasonable, necessary and proportional force to implement the law.<\/span>

Francisco said that the arguments against the death penalty are known. The Church – said-, mentioned some, such as the possibility of judicial error and use that give the totalitarian regimes as an \u00abinstrument of suppression of political dissent and persecution of religious or cultural minorities\u00bb.<\/span>

He also expressed against the imprisonment as \u00aba hidden death sentence\u00bb.<\/span>

The Holy Father also condemned torture and warned that the same criminal doctrine has an important responsibility in this for allowing, in some cases, the legitimization of torture under certain conditions, paving the way for further abuses.<\/span>

In his speech, Francisco also called upon lawyers to take legal and political instruments that do not fall into the logic of the \u00abscapegoat\u00bb, condemning the sacrifice people unjustly accused of the misfortunes that affect a community.<\/span>

\nHe also addressed the situation of prisoners without conviction and convicted without trial. He noted that pre-trial detention, when used abusively, is another contemporary form of hidden illegal penalty, beyond the law.<\/span><\/p>\n

He also referred to the deplorable conditions of the prison in good part from the planet. He said that although it is sometimes due to the lack of infrastructure, others are the result of the \u00abarbitrary and ruthless exercise of power over the persons deprived of their liberty\u00bb.<\/span>

Francisco did not forget the application of criminal sanctions to children and elderly condemning its use in both cases. It also condemned human trafficking and slavery, \u00abrecognized as a crime against humanity and a war crime by international law as in many national legislations\u00bb.<\/span>

The Pope also referred to poverty absolute suffering one billion people and corruption. \u00abThe scandalous concentration of global wealth is possible because of the connivance of those responsible for public life with strong powers. Corruption, is itself a process of death… and an evil greater than sin. An evil that forgive most have to heal \u00ab, warned.<\/span>

\u00abCaution in the application of the penalty must be the first Alderman of the penal systems… and the respect for human dignity must not only act as limit of arbitrariness and excesses of agents of the State, but as a criterion for orientation to pursue and punish behaviours<\/span> which represent the most serious attacks on the dignity and integrity of the person\u00bbHe concluded.<\/p>\n
